Florida's Strict Liability Dog Bite Law

Florida's Strict Liability Dog Bite Law

 Florida Statute § 767.04 makes Florida one of the strongest states in the country for dog bite victims. Under this law, a dog owner is strictly liable for injuries caused by their dog biting a person in a public place or lawfully on private property — regardless of whether the dog had ever bitten anyone before. There is no "one free bite" rule in Florida. You do not need to prove that the owner knew the dog was dangerous. You simply need to show you were bitten and that you were lawfully present. 


The only potential defenses available to the dog owner are comparative negligence (if you provoked the dog) or a posted "Bad Dog" warning sign. Even then, if you were a child under age six, the sign defense may not apply. 

What Damages Can You Recover?

A successful dog bite claim in Florida can include compensation for: medical expenses (emergency care, surgery, stitches, infection treatment, plastic surgery); lost wages and lost earning capacity; pain and suffering; emotional distress and psychological trauma; permanent scarring or disfigurement; and future medical care.

What to Do After a Dog Bite

If you have been bitten by a dog, take these steps immediately: seek medical attention, even if the wound appears minor — infections and nerve damage may not be immediately visible; identify the dog and its owner and request proof of rabies vaccination; photograph your injuries, the location, and the dog if safely possible; report the bite to local animal control; and contact an attorney before speaking with the owner's insurance company.
