Florida Landlord/Tenant Attorney-Know Your Rights Fight Back

Tenant Rights Under Florida Law

Florida law provides significant protections for tenants. Under the Florida Residential Landlord and Tenant Act (Chapter 83, Florida Statutes), landlords are required to maintain rental properties in a habitable condition, provide proper notice before entry, follow strict procedures for evictions, return security deposits within 15 days of lease termination or provide written notice of any claimed deductions from a security deposit within 30 days. When landlords fail to follow these requirements, tenants have legal remedies — including recovery of security deposits, damages, attorney's fees, and in some cases the right to terminate the lease.

Common Landlord/Tenant Issues We Handle

Medgebow Law handles a full range of landlord/tenant matters including: wrongful eviction and illegal lockouts; failure to return security deposits; improper security deposit deductions; breach of lease by landlord or tenant; habitability issues and failure to make repairs; retaliatory eviction; lease review and negotiation; commercial lease disputes; and demand letters and pre-suit negotiations.

Security Deposit Disputes

If your landlord fails to return your deposit within the required timeframe, fails to provide proper written notice of deductions, or makes improper deductions, you may be entitled to recover the full deposit plus additional damages. Medgebow Law has successfully resolved hundreds of security deposit disputes for Florida tenants.

Eviction Defense

If you have received an eviction notice, you have rights. Florida law requires landlords to follow strict notice and procedural requirements before a tenant can be removed. Errors in the process can result in dismissal of the eviction. Do not wait — contact Medgebow Law immediately if you have received a notice to vacate or an eviction complaint.
